1     MR. DEVLIN:  The next matter on the counsel list is Scarlett B., lines 26 to 28 on page 2.

2     MR. PENNEY:  Ms Scarlett B. is coming forward, I see the brief just to my friend's right there. This is a matter where Ms Scarlett B. has completed Diversion on the simple-possession charge.

3     MR. DEVLIN:  Just a moment's indulgence. Can the Court tell me if the Information reflects Ms Scarlett B. is charged only with the simple possession?

4     MR. PENNEY:  No, she is charged with trafficking, possession for the purpose, and simple possession. I had a pre-trial with Ms Hayes on Monday. She indicated that she would divert the simple possession. The other two would be withdrawn upon completion of the Diversion.

5     CLERK OF THE COURT:  The simple possession of marijuana is count 3.

6     MR. DEVLIN:  Yes, that's correct. Ms Scarlett B. has completed Diversion, and pursuant to the agreement Ms Hayes has with my friend, I would ask that the charges against this young lady be withdrawn.

7     THE COURT:  All three counts?

8     MR. DEVLIN:  Yes, please.

9     THE COURT:  All right.

10     MR. PENNEY:  Thank you, Your Worship. I thank you my friend.
