Pascal's Case — Sexual Assault — Police Report Client: Pascal
M., Accused Police Report: Between Wednesday, January 1st, 1991, and Sunday, December 31st, 1994, the Accused before the Court, Pascal M., was staying at the home of the victim. The Accused is the victim's uncle. The Accused was sleeping in the victim's bed. The victim was sleeping on the floor beside him. This occurred when the victim was approximately 12 years old, and the victim remembers it was a Christmas Eve. During the night, the Accused placed his hand several times on the victim's penis. The victim removed the Accused's hand and told him to stop. Later in the night, the victim woke up and his jogging pants were pushed down to his knees. The Accused was masturbating the victim's penis and masturbating himself. The victim again stopped the Accused and the Accused left the room. The victim was crying at this point. Shortly after this, the Accused permanently left the family home. He did not disclose the incident to his mother or stepfather because the Accused was the favourite brother of his mother. On the 19th of February 2002, the Accused called police to report he was being extorted by the victim. The Accused disclosed to the attending police officers that he had assaulted the victim approximately 8 years previously, and that he had been paying the victim not to tell anyone ever since. He then added he had also been paying the victim for sex for the last two years. The victim had left the apartment prior to police arrival. The police officers took a report and attempts were made to locate the victim. On the 12th of March 2002, the victim was located in Waterloo. The victim refused the opportunity to tell his story on video, bud did relate the incident to Detective Sergeant Ian S*** #5** of the Waterloo Regional Police. Based on this information, the Accused was arrested on the 15th of March 2002 and brought to 52 Division. The Accused was investigated and released on a Form 10 and 11.1. |
