5     MR. STRATOS:  There's been a few changes in direction in this matter. We're missing a witness today in relation to the — sorry, in regards to David M. and Nick J.

6     THE COURT:  Yes.

7     MR. STRATOS:  We are missing a witness today in order to prove the credit card offence. I'm going to be inviting Your Honour to dismiss the charge, that charge against both individuals at this point.

8     THE COURT:  All right, that is it for Mr. Nick J. then, is it not?

9     MR. PENNEY:  Yes, if I could be excused please Your Honour?

10     THE COURT:  All right. It will be just a moment to do that before you are out the door.
