Floyd's Case — aBH, threat & firearms — Police Report

Police Report:  Assault Causing Bodily Harm and Threatening Death:

The accused in this matter is 58 years old, Floyd H., who resides with his elderly mother, the victim, 89-year-old Janet H. The two live alone in a single family house located at 310 Hamlet Street North in the city of Brampton.

The victim moved into the accused's house from a separate apartment in Toronto approximately two years ago after being convinced by the accused that it would be more cost effective for her to live there.

There have been no reported calls of domestic related incidents to the residence.

The accused has a "possession only" licence for firearms and is a gun collector in addition to the two guns involved and seized in the present charges. The accused has a locked metal gun case in the basement of his residence, of which contains approximately 5 rifles and a hand gun.

The investigating officer has requested that the Crown seek a condition on release that the accused surrender these weapons and related ammunition to a suitable third party who is over the past 30 days ending the 28th of January, 2002. The accused has increased his alcohol intake and become increasingly abusive towards the victim. During this period, the accused has become upset on a number of occasions and lashed out at the victim. The accused has forcefully grabbed the victim by the arms and thrown her to the ground resulting in bruising and redness to that area. Due to the repeated arm grabbing and twisting, the victim has open sores on the arms caused by the accused.

The wounds re-open on each assault and still have not healed. On other occasions, the accused has thrown the victim to the ground and punched her in the back, her arms, and the back of her head repeatedly, resulting in bruising to those areas. The accused has also stated to the victim on two occasions, "I will hurt you so very much. I will kill you."

On Monday, January 28th, 2002, the victim indicated that she could no longer face the constant assaults and indicated that she would be moving.

The accused again lashed out at the victim, punching her in the eye with a closed fist, and knocking her to the ground. The accused then punched her in the back of the head and side while she laid on her side.

On the 29th of January, 2002, in the evening hours, the victim attended a neighbour's house seeking assistance in getting her money and property from the accused. Appalled by the obvious bruising, the neighbour's contacted police.

The victim's injuries consisted of bruising and swelling to the right eye socket and forehead, swelling to the back of her head, bruising to her left hand, large scabbing and bruising to her left forearm. The victim was taken to the Forensic Identification Bureau to have her injuries photographed. The victim was not and is not planning on seeking medical treatment for her injuries.

Later with the assistance of victim services, the victim was transported to a friend's residence in Toronto until she could obtain suitable housing.

Careless Storage of a Firearm (4x):

On Tuesday the 29th of January 2002, at approximately 6:05 p.m., the accused was located in the bedroom of his house for the offences of assault causing bodily harm and threatening death. At that time, police located two firearms under the bed which were fully functional and with no trigger-guard or locking mechanisms in place.

The first was a Winchester Model 1300, 12 gauge shotgun. The second firearm was a Winchester Model 940AE44 calibre rifle.

Additionally, in an adjacent room, police located two full boxes of ammunition suitable for the firearms found under the bed.

In those boxes contained 25 Winchester 12 gauge shotgun shells. The second box contained 20 Winchester Centrefire cartridges.

The accused was advised of the additional charges of careless storage of a firearm, read his rights to counsel, cautioned, and later returned to 22 Division where he was held for a bail hearing.
